Overview

MidHealth Labs operates as a telehealth coordination platform under the laws of India. This page sets out the regulatory framework within which we operate, the licences and registrations we hold or that govern our operations, and our commitments to clinical, data, and advertising compliance.

Legal structure

MidHealth Labs is a service brand operated by Learnovate Skills Private Limited, incorporated under the Companies Act 2013. The company holds GST registration and complies with applicable tax obligations. The platform operates under the provisions of the Information Technology Act 2000 and qualifies as an intermediary under Section 79 of that Act.

Telemedicine compliance

MidHealth Labs operates in accordance with the Telemedicine Practice Guidelines 2020, issued by the Board of Governors of the Medical Council of India as Appendix 5 to the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations 2002.

We are a technology platform. We do not practice medicine. We do not employ doctors. All clinical decisions, diagnoses, and prescriptions are made by independent Registered Medical Practitioners (RMPs) who are registered with the National Medical Commission or their respective State Medical Councils.

All doctors on the platform hold valid medical registration. All prescriptions issued through the platform are digital prescriptions issued by the treating RMP in compliance with the Telemedicine Practice Guidelines. All medications dispensed are Schedule H drugs prescribed in accordance with the Drugs and Cosmetics Act 1940 and the Drugs and Cosmetics Rules 1945.

We do not prescribe Schedule X drugs, narcotic substances, or psychotropic substances through the platform. We do not dispense medications without a valid prescription from an RMP.

Pharmacy compliance

Medication dispensing and delivery is handled by a licensed pharmacy partner operating under a valid retail drug licence issued under the Drugs and Cosmetics Act 1940. MidHealth Labs does not hold a drug dispensing licence and does not stock, dispense, or deliver medications directly.

Data protection compliance

We comply with the Digital Personal Data Protection Act 2023 (DPDPA) as a Data Fiduciary. We have implemented appropriate technical and organisational measures to protect personal data in accordance with the Act. We maintain records of processing activities, obtain explicit consent before processing sensitive health data, and provide users with the rights prescribed under the Act.

We comply with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules 2011 with respect to the collection, storage, and processing of sensitive personal data including health information.

Advertising and marketing compliance

All marketing and advertising materials published by MidHealth Labs comply with the Drugs and Magic Remedies (Objectionable Advertisements) Act 1954. We do not directly advertise prescription medications to consumers. All consumer-facing communications promote our consultation service and clinical support program, not the medications themselves.

All paid partnerships with creators and influencers are disclosed in accordance with the Advertising Standards Council of India (ASCI) Guidelines for Influencer Advertising in Digital Media 2021. Sponsored content includes clear disclosure labels as required.

We do not make false, misleading, or exaggerated claims about health outcomes. All clinical statistics referenced in our communications are sourced from peer-reviewed literature or validated clinical data and are attributed accordingly.

Consumer protection compliance

MidHealth Labs complies with the Consumer Protection Act 2019 and the Consumer Protection (E-Commerce) Rules 2020. Our subscription terms are clearly disclosed before purchase. Cancellation and refund rights are clearly communicated. We maintain a grievance redressal mechanism as required under these rules.

Grievance officer

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, we have designated a Grievance Officer to address complaints related to our platform.
